Will, Power Of Attorney And Living Will Documents

We are not attorneys nor do we play them on TV. However, we do see problems on a regular basis and want to help our clients avoid those problems.

The Will

In our opinion, the Will destroys more families than any other document. When you pass away, we assume that you want your children or beneficiaries to continue to have a strong, loving relationship. One of the quickest ways to destroy that is typically found at the bottom of page one of your Will that discusses the tangible assets of your estate.

Boiler plate language says to “equally divide” your tangible assets among your children or beneficiaries. You can’t do that. Let’s say you have three piano playing children and one piano. You cannot divide that equally. Nor can you divide your car, home, jewelry, artwork, etc. equally. We can help you with this problem.

Power Of Attorney Documents For Healthcare And Finance

We look for a clear designation of agent and contingent agent. We also look for the trigger clause that activates these documents. Finally, we warn people about the abuse of the compensation clause. 

Community Property Agreement

This document is extremely important to anyone receiving an inheritance and wanting to keep those assets as separate property.

Living Will Or Healthcare Directive

Should you have a Living Will or a Power of Attorney Healthcare or both? This is a very important decision.
